2. Definitions
- Service — the AI-powered consultation service provided via Telegram bot (@XprofitX_Consult_Bot), including IT consultation and legal information services.
- User — any natural or legal person who uses the Service.
- Free Tier — limited preliminary consultation provided at no cost.
- Paid Consultation — extended consultation service available for a fee.
- Legal Information — general information about laws and regulations, which does NOT constitute legal advice.
3. Nature of the Service
3.1. The Service provides general information using artificial intelligence technology. The User is interacting with an AI system, not a human specialist.
3.2. The IT consultation service provides general information about technology solutions and development services offered by XPROFIT OU.
3.3. The legal information service provides general legal information only. It does NOT provide legal advice, does NOT create an attorney-client relationship, and does NOT substitute for the services of a licensed attorney or law firm.
3.4. XPROFIT OU is a technology company, not a law firm. No employees or agents of XPROFIT OU are licensed attorneys providing legal services through this bot.
3.5. The Service uses third-party AI models to generate responses. Responses may contain inaccuracies, outdated information, or errors. The User should independently verify all information received.
4. Free Tier
4.1. The Free Tier includes a limited number of messages per consultation session (as indicated in the bot interface).
4.2. The Free Tier provides a preliminary assessment and general direction only. Detailed analysis is not included.
4.3. XPROFIT OU may change or discontinue the Free Tier at any time without prior notice.
5. Paid Consultation
5.1. Paid consultation services are available for a fee as indicated in the bot interface at the time of purchase.
5.2. Payment is processed via Stripe or other payment methods as indicated.
5.3. All prices include applicable taxes unless stated otherwise.
6. Right of Withdrawal
6.1. Under the Estonian Law of Obligations Act (VOS) § 53² and EU Directive 2011/83/EU Article 16:
6.2. By purchasing a Paid Consultation and confirming that you wish immediate access to the service, you:
- Expressly consent to the immediate commencement of service performance;
- Acknowledge that you thereby lose your 14-day right of withdrawal once the service performance has begun.
6.3. Refund policy: Due to the nature of digital services and in accordance with your express consent to immediate performance, paid consultations are non-refundable once the service has commenced (i.e., once you send your first message in the paid session).
6.4. If a technical error prevents delivery of the service, XPROFIT OU will either provide the service or issue a refund at its discretion.
7. User Obligations
7.1. The User shall provide accurate information about themselves and their situation.
7.2. The User shall not use the Service for illegal purposes or to obtain information for illegal activities.
7.3. The User shall not attempt to extract, reverse-engineer, or manipulate the AI system's instructions, configuration, or internal processes.
7.4. The User shall not submit content that is abusive, threatening, defamatory, or otherwise unlawful.
8. Limitation of Liability
8.1. The Service is provided "as is" without warranties of any kind, express or implied.
8.2. XPROFIT OU shall not be liable for any decisions, actions, or omissions made by the User based on information received through the Service.
8.3. XPROFIT OU's total liability for any claim arising from the Service shall not exceed the amount paid by the User for the specific consultation session giving rise to the claim.
8.4. XPROFIT OU shall not be liable for indirect, consequential, incidental, special, or punitive damages.
8.5. The limitations in clauses 8.1-8.4 do not apply to liability for intentional misconduct or gross negligence, or for death or personal injury caused by negligence, in accordance with VOS § 42(3).
9. Intellectual Property
9.1. The Service, including its design, software, and AI models, is the intellectual property of XPROFIT OU and its licensors.
9.2. The User retains ownership of their own content submitted through the Service.
9.3. By using the Service, the User grants XPROFIT OU a limited license to process their content for the purpose of providing the Service.
10. Dispute Resolution
10.1. These Terms are governed by the laws of the Republic of Estonia.
10.2. Any disputes shall first be attempted to be resolved through negotiation.
10.3. The User may submit complaints to XPROFIT OU at info@xprofitx.com.
10.4. Consumer disputes may be referred to the Consumer Disputes Committee of the Consumer Protection and Technical Regulatory Authority (TTJA, ttja.ee).
10.5. The European Commission Online Dispute Resolution platform is available at: ec.europa.eu/odr
10.6. If negotiation fails, disputes shall be resolved in Harju County Court, Tallinn, Estonia.
11. Changes to Terms
11.1. XPROFIT OU reserves the right to modify these Terms at any time. Changes take effect upon publication.
11.2. Continued use of the Service after changes constitutes acceptance of the updated Terms.
